CONDITIONS OF SALE

These general conditions of sale (hereinafter, the general conditions) have as their object the regulation of the purchase of products and services carried out remotely and made available, via the internet, from the website www.NEEDSTORE.it (hereinafter, the site)

Premise

All purchases of products and services made through the site (hereinafter, the purchase contracts) by users who access it (hereinafter, customers) are governed by the general conditions as well as by the other provisions and operating instructions contained on the site. In the event of a conflict between the provisions of the aforementioned provisions and operating instructions and the contents of the general conditions, the latter prevail.

Any operation and / or payment conditions that may be granted to the customer in derogation from the general conditions will be valid only if the site has accepted this derogation condition in writing.

The provisions of these general conditions apply equally to all customers, except for those provisions for which applicability to consumer customers has been expressly provided. By "consumer customer" we mean a natural person who purchases the products or services offered by the site for purposes unrelated to any business or professional activity carried out; for the purposes of these general conditions, it is assumed that the customer who sends a proposal for the purchase of products or services by entering his VAT number in the area of the site relating to the customer's personal data is not a "consumer customer". Articles 50 to 63 of Legislative Decree no. lgs. n. 206/2005.

The site may modify, at any time and without notice, the content of the general conditions referred to in this document. Any changes made will take effect from the date of publication on the site, as declared in the heading of the general conditions themselves.

Purchase procedure

The customer can purchase the products in the electronic catalog of the site, illustrated in detail on the home page and within the respective sections by product category, as described in the relevant information sheets contained on the site, respecting the technical access procedures illustrated therein. The publication of the products and services displayed on the site constitutes an invitation to the customer to formulate a contractual purchase proposal. The order sent by the customer has the value of a contractual proposal and implies full knowledge and full acceptance of these general conditions.

The correct receipt of the customer's proposal will be confirmed by the site through an automatic reply sent to the e-mail address supplied by the customer. The response will be generated automatically by the system and only confirms the correct receipt of the proposal. This confirmation message will indicate the 'order number' to be used in any subsequent communication with the site.

Each purchase contract stipulated between the site and the customer must be considered concluded with the acceptance of the order by the site which has the right to accept or not, at its discretion, the order sent by the customer, without the latter being the latter may make claims or rights of any kind, for any reason, including compensation, in the event of non-acceptance of the order itself. The acceptance by the site is considered tacitly granted, unless otherwise communicated to the customer within 48 hours of sending the order, by means of an e-mail message sent to the address communicated by the customer.

NEEDstore Product prices, delivery costs and product availability

All product prices are clearly indicated on the site and are inclusive of VAT only. They do not include any additional and different taxes, duties or duties established by the relevant applicable legislation, such as those provided for in the matter of imports. If due, the customer will therefore have to clear the imports and pay any duties and taxes (other than VAT) that may be due in the importing country.

The prices and availability of the products shown on the site are subject to change at any time and without notice, it being understood that, limited to orders being accepted or as accepted above by the site, the conditions of sale in force at the time of sending the order by the customer.

The site highlights the products available for shipment, this product availability is not updated in real time, furthermore, in consideration of the possible simultaneous access to the site by many users, the actual availability of individual products may vary significantly during the same day compared to the instructions on the site The site does not undertake any commitment nor does it guarantee the certainty of immediate delivery of the products purchased and indicated as available on the site and therefore it will in no case be responsible for any delays in delivery.

In the case of payment by bank transfer, the site reserves the purchased products for 2 days, the time within which the customer must notify the payment via email or other means made available to communicate with customer service.

If the delivery times of the ordered product are delayed with respect to the delivery times indicated on the site before the order, the site undertakes to promptly notify the customer via an e-mail message to the address indicated by the customer. Until the time of shipment by the site, the customer has the right to cancel the order or modify it.

The cost of each shipment, the amount of which may vary according to the method of delivery and payment as well as the country of destination and the total amount of the order, is added to the total price of each purchase and is clearly indicated and communicated to the customer. through the site, before the conclusion of the purchase contract.

Therefore NEEDstore is only an intermediary for the transfer and shipment but does not assume responsibility for any discrepancies in the goods. For any kind of dispute regarding the purchase of a partner product, the customer can ask the NEEDstore customer service for the partner's data and then refer to it.

Quality check

All products are subject to careful quality control before shipment.

Products that do not pass quality control (because they have manufacturing defects) are not shipped.

In the event that a product is not shipped due to defects, the order is canceled and all sums paid by the customer during the purchase are immediately refunded.

The customer is notified of the cancellation by customer service through one of the contact details provided during the order.

Right of withdrawal

The right of withdrawal is regulated in accordance with the law (Art. 49 to 59 of the Consumer Code) if the customer-consumer (ie a natural person who purchases the goods for purposes not related to his professional activity, or does not carry out the purchase by indicating a VAT number in the order form) has the right to withdraw from the purchase contract for any reason.

To exercise this right, the customer must send a communication to service@needstore.it within 14 working days from the date of delivery of the goods.

Please note: customers who purchase with VAT number cannot exercise the right of withdrawal.

The right of withdrawal will in any case be subject to the following conditions:

1. the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

2. to limit damage to the original packaging, we recommend, when possible, to put it in a second box (avoid in all cases affixing labels or adhesive tapes directly to the original product packaging);

3. the shipment, until the certificate of receipt in our warehouse, will take place under the complete responsibility of the customer;

4. the transport costs for the return of the goods are charged to the customer-consumer;

The site is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments. In no case will not be collected parcels on delivery or carriage forward.

Goods return:

The product must be returned to the site within 14 days from the date on which the consumer communicated his decision to withdraw from the contract, together with the authorization form received, without prejudice to any restoration costs for damage to the original packaging. The site will reimburse the customer the full amount already paid for the product, including delivery costs (with the exception of the additional costs deriving from the choice of a type of delivery other than the least expensive one offered by the site) by means of a cancellation procedure. amount using the same payment method used by the consumer. When the right of withdrawal expires:

the right of withdrawal is totally lost, for lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where the site ascertains:

2. the lack of the external packaging and / or the original internal packaging;

3. the absence of integral elements of the product;

4. damage to the product for reasons other than its transport

In the cases indicated above, the site will make the purchased good available to the sender for collection.

In no case can customers who purchase with VAT number exercise the right of withdrawal.

Communications and complaints

all communications or any customer complaints against the site relating to purchase contracts must be addressed to the customer service responsible for managing the site through one of the methods made available.

Jurisdiction

The purchase contract between the customer and CLADAN CALZATURE s.r.l. it is understood to be concluded in Italy and governed by Italian law. For any dispute, the judicial authority of the place of residence or domicile of the consumer will be exclusively competent, if located in the territory of the Italian State.
